A prenuptial agreement is a contract between you and your partner entered into prior to marriage which sets out the financial terms of the relationship.
It will last for the duration of the marriage and sets out how assets are to be divided in the event of a relationship breakdown.

  • When is a good time to consider a prenuptial agreement?
    Generally speaking, the sooner expert legal advice is sought the better. If this is left until the last minute, then potentially your spouse could challenge the agreement on the grounds of undue pressure or lack of legal advice if there is insufficient time to consider matters properly before the marriage. As a general rule, an agreement should be signed at least 28 days prior to the marriage.
  • Do I have to disclose my financial position?
    Yes. Both parties have a duty to disclose full and frank financial information and this exercise can usually be undertaken with guidance from solicitors.
  • Are there any other documents or agreements I should consider?
    Depending on the individual circumstances, it may be advisable to consider a Declaration of Trust in respect of real property being purchased jointly, or it may be advisable to consider making or updating your will in contemplation of the marriage, especially if you have children. HK Law can provide further tailored advice about such issues when preparing a prenuptial agreement.
