School Academy Conversion Process

Conversion from school to academy schools status brings many freedom and privileges, but the process can be fraught with difficulties without proper management.

How can Humphries Kirk support the school academy conversion process?

Led by Caroline Carretta, Commercial Partner, our Schools and Academies team has wide experience of the conversion of maintained schools to academy status, the formation of multi-academy trusts (knows as “MATs”) and the transfer of existing maintained schools and/or academies into larger MATs.

We can help guide the Governing Bodies and Senior Leadership Teams through the process. Our input typically includes: liaison with the Department for Education, Local Authority and/or other stakeholders as necessary; drafting and negotiation of the funding and transfer documents, dealing with Articles of Association and Schemes of Delegation for MATs; dealing with the transfer of the School site and any other property issues; assistance with the TUPE process in relation to the transfer of employees, and preparation for governor, staff and parent meetings. In our experience, every school or academy has different specific issues and we will be on hand to address any particular concerns.

We can help you whether you are a maintained school considering conversion, or a MAT or stand-alone academy wishing to acquire, or transfer into, another academy trust. Please contact Caroline Carretta (cc@hklaw.uk) or Samantha Hurrell (s.hurrell@hklaw.uk) with any enquiries or if you would just like an initial talk about any general school or academy issues.
