What is Conveyancing?

Spring is in the air … certainly for conveyancing.

Conveyancing is basically the buying and selling of homes, whether houses, flats or bungalows. The market has now picked up and the volume of properties on sale has increased, meaning there are more buyers searching and more property transactions happening, which in turn provides for a positive mood in the market.

Property lawyers at Humphries Kirk offer the following advice on the conveyancing process:-

  • A buyer must ensure that their financial arrangements are in place and apply for a mortgage if necessary
  • Once a seller has found a buyer and a price has been agreed, a contract package will be drafted by the seller’s solicitor and issued to the buyer’s solicitor. The paperwork in this contract package will include a draft
    contract, title documents for the property, planning paperwork and the property forms completed by the seller
  • It is advisable to begin the relationship with your solicitor or legal advisor as soon as you can.  It is important for legal services to be engaged early in the process of moving house to enable all issues to be resolved as soon as possible
  • A survey will also need to be carried out to ensure there are no potential issues with the property as the transaction will be subject to the principle of “buyer beware”
  • The buyer’s solicitor will review the paperwork supplied and searches and enquiries will be undertaken. Each party’s solicitor will then report with various paperwork to sign, explaining the procedures in plain English
  • Exchange of contracts  – this is when the completion date is fixed, a deposit is paid and all parties are bound into the transaction
  • Completion date  – this is the moving date, the date on which funds are paid and the buyers  collect the keys
