Partial refunds for Lasting Power of Attorney (LPA)

If you have applied to register a Lasting Power of Attorney (LPA) or Enduring Power of Attorney (EPA), the Government has launched a scheme to enable people in England and Wales to claim back any excess of fees paid to the Office of the Public Guardian (OPG).

The Government recently launched the OPG refund scheme, which will enable applicants to receive part of their fee back, is valid for fee payments between 1 April 2013 and 31 March 2017.

Refund claims must be made by 31 January 2021 by either the person (donor) who made the Power of Attorney, or the person who has been appointed as an LPA or EPA to make decisions on behalf of the donor. However the refund can only be paid back to the donor and how much you can get back varies between £34 to £54, depending on when the application to register a LPA or EPA was made.

The refund scheme is available online and it takes around 10 minutes. Alternatively if the donor has died, doesn’t have a UK bank account or you are a court-appointed deputy, then you must phone the refund hotline instead.

Our advice is to follow this link in order to start processing any refund that you might be due. Before you can begin the claim you will need the donor’s UK bank account number and sort code and a copy of the LPA, if you have it. You can also claim over the phone by calling 0300 456 0300 (choose option 6).

It takes an average of 12 weeks for the refund to be processed, if approved the funds will be paid to the donor’s bank account and any rejected claims can be appealed using the Refunds Helpline above. There are also special steps to follow if the donor has since passed on.
