Make a Will – Humphries Kirk’s Will Week

Have you made your Will? No? Shockingly some 70% of adults in the UK haven’t. Just consider the following:

  • Your spouse or civil partner will not inherit everything automatically if you haven’t made a Will. English intestacy rules (the law that applies if you don’t leave a Will) do not provide this.
  • Do you want your unmarried partner to inherit if you die? If so it’s crucial that you make a Will because he/she will not inherit under the intestacy laws.
  • Do you have children under age? It’s crucial that you appoint a guardian or guardians who will be responsible for bringing up your children if the worst happens. If you don’t appoint a guardian the Court will decide who is to look after your children.
  • Do you or your spouse or partner have children from previous relationships? Do you want to make sure that some of your estate passes eventually to your children rather than to your spouse’s/partner’s children or to his/her new spouse/partner at the end of the day?
  • If you die without a Will and leave no relatives, however distant, your estate will pass to the State.
  • You can name your choice of executors in a Will: they will be responsible for winding up your estate.
  • A properly drawn up Will can save you inheritance tax in certain circumstances.
