What is a guardianship clause?
A Guardianship clause in your Will allows you to name a trusted person, often a close family member or friend, to take legal responsibility for your children if you die before they reach adulthood. It gives that person parental responsibility and ensures your child won’t be caught in a period of limbo while the court tries to appoint someone on your behalf.
Without it, social services may have to get involved and your child could temporarily be placed in care. That’s a stressful and traumatic experience that can be avoided entirely with the right legal steps.
Why parents delay – and why it matters
Common reasons parents gave for not naming a guardian include “we couldn’t agree on who to choose”, “we didn’t think it was urgent”, or “we thought it would be too complicated.” All valid concerns, but none that should get in the way of safeguarding your child’s future.
Choosing a guardian is an emotional decision, but it’s also one you can revisit and revise as life changes. It’s not a once-and-done commitment, it’s about taking a sensible, caring step today to protect against uncertainty tomorrow.
