Explaining the divorce process

Leanne Weatherill, solicitor at Humphries Kirk, explains the divorce process:

The divorce process is fairly straight forward, and usually takes six months to finalise. Neither party needs to attend the court, nor is it a solely paper based process.

Divorce only dissolves the marriage; it does not end the financial claims that have arisen as a result of the marriage. If they are not, and for example, the week after your Decree Absolut you win the lottery, your former spouse can claim a share.

If you are considering filing for divorce, please contact our family department at your local Humphries Kirk branch for advice.
