At HK Law we understand the trials and tribulations which you may be experiencing as a result of a relationship breakdown and appreciate that this is a significant decision in your life.

We can help you consider the wider factors of a divorce such as financial settlements and child arrangements. One of the elements that we help explain are the court costs that will be incurred as part of the process.

From May 2024, it has been confirmed that the Family Court fees are increasing by 10%. This increase is to enable the court to improve the service they provide and, to reduce burden of the  HMCTS on the taxpayer. In 2022/23, the income received from fees was less than half of the running costs.

From May 2024 the following court fees are due to increase as follows:

  • Application for a Child Arrangement Order – increase from £232 to £255
  • Application for a contested financial remedy order – increasing from £275 to £303
  • Application for a financial order by consent – increasing from £53 to £58
  • Lodging an application within proceedings without notice – increasing from £53 to £58
  • Lodging an application within proceedings on notice – increasing from £167 to £184

It was proposed that the divorce application fee which is currently £593 would be increasing however, it was considered upon consultation that the proposed increase to £652 would be  disproportionate. The divorce application fee will therefore remain at £593.

If you are on a low income or, have limited savings, you may be able to apply for a fee exemption or remission of these court fees.
