Bringing a claim, or defending one

Michelle Dixon, associate solicitor at Humphries Kirk, offers advice for those bringing a claim or defending one:

Litigation is the process of taking legal action against a person or organisation; for money, or compensation for injury, or damage to property.

You may not recover all of your legal costs; such as in a claim for money below £10,000. So, check whether you have any legal expense insurance. Also, consider if your opponent has the money to pay you if you win.

However, always be willing to try and resolve the dispute by alternative means, such as mediation.

If you require advice regarding claims, please contact your local Humphries Kirk branch for advice from our litigation department.
